What are all of the deed restrictions in Top of the World? Please tell me everything the $391 per month covers.

The monthly assessment is extremely high and totally out of proportion to the actual home value..($392.00 ) and rising!!..It is zoned like a Condo, so you actually own nothing but the interior and must get approval to do anything, even indoor repairs or upgrades, which require a permit and of course an attached fee.
People soon find out they have very little power over their own property and are basically paying rent for the right to occupy space.

On Top of the World is a huge 55 plus retirement community located in SW Ocala Florida. Sidney Collen, a visionary Florida builder, purchased the 12,872 acre Circle Square Ranch in 1975 and began to develop On Top of the World in 1982. His son is still building new homes here today.

On Top of the World is unique in Ocala real estate for a couple of reasons. This is a leasehold property which is unusual for our area. This means that you own the house but the lot is leased for 99 years from the time of the first sale. A buyer also can’t finance more than 80% of the purchase price of their home. Unlike most Ocala 55+ communities all outside maintenance is part of the HOA fees.

In addition to new homes there are quite a few resales here. Older homes are often attached in groups of 4 to 6 and of concrete block and stucco construction. The newer homes are single detached and also CBS. Sizes range from 1,000 to about 2400 sq ft of living area. Prices start as low as $40,000- and go up to $200,000- for resales.

HOA fees at On Top of the World are high, around $391- per month, because they include all outside maintenance including lawns, painting and roof repair but not replacement as well as property insurance on the building but not the contents or interior. In addition there is a 24 hour guard at the gate and too many amenities to list.

Amenities include the Arbor Club with indoor and outdoor pools and tennis, the Health and Rec Center with a fitness center, racquetball, steam room etc. and a craft building with a complete woodworking shop, The Spa Ranch and Fitness Center, a library, a dog park, a bus service for shopping and the Circle Square Cultural Center. There are 2 golf courses, the Tortoise and Hare and The Links. Golf, the Ranch Spa and Fitness and the Cultural Center all have fees above and beyond your HOA fee.

On Top of the World is also a golf cart community which means you can drive your cart down the street. You can even access 2 grocery stores, small shops and a few restaurants with your golf cart.

Not all properties at OTOW are leasehold. Properties in Candler Hils as well as Indigo East are not leasehold properties.

Thank you Conrad and Bob for your very complete answers! We are selling our home in England and moving to Ocala in 3 - 4 months. We are still deciding what to do. We would rather not have such high HOA fees however it seems that the lowest priced homes are in Top of the World. I think what we do will depend on how much we get for our current home. We are contemplating buying something very cheap like a foreclosure and being able to pay cash vs getting something a little better and getting a mortgage. I am from FL and still have good US credit, my husband is British and has no credit. Plus, neither of us are employed yet in FL so getting a mortgage may be tricky. So... all options still open at the moment. Haven't had a chance yet to look at the deed restrictions you very kindly gave me a link to Bob but I will.

Dianne, Just checking to see how you and your husband made out in Ocala. I am in the same situation you were when you made the post in 2012--Florida is my home of record and my husband is German. We are also looking at Top of the World, but considering other locations as well. mrsschmitt@live.com

That's a great question and one that we often get asked. On Top of the World has an extensive list of amenities homeowner benefits which you receive for your HOA Fees. These include (but are not necessarily limited to) the following...

• Insurance coverage on the exterior of the home including roof (deductible assessed to home owner)
• Lawn maintenance
• Roof maintenance
• Irrigation maintenance
• Pressure washing and painting of exterior of home every 7 years
• Maintenance of common area
• Maintenance of road and parking
• Trash removal (dumpsters in designated areas)
• Yard waste picked up curb side once a week
• Water & Sewer (Dependent on the Neighborhood)
• Basic cable (16 channels)
• Gated access
• 24 hour guard
• Shuttle transportation
• Access to the community center
• Club houses
• Swimming pools
• Fitness center
• Dog park
• Community clubs and organizations
• Access to 2 private golf courses (fees will apply and may vary)
• Access to the Candler Hills Golf Course (fees will apply and may vary)
