We own a mobile home we just brougt from the owners of the park where the home is located. We had been paying

them a set amount every month toward taxes.We just found out, that the taxes are half of what they were telling us they were, after we got our first tax bills. My question is, would we be lible for the taxes on the land, in the park where the trailer sits, or just for the home its self? Any ideas??

Thanks :) We did contact both the borough and county tax offices, and they told us exactly what the bills we recieved in the mail said, Half of what we were giving them. The county office thought that since it was a parcel of 'developed' land (that the park owners were also paying on) That they may have combined the house tax and the land tax in one bill for them. Once the house was transfered to us, then the bill lowered for us because all we were paying on, was the house. They said the house (mobile home) had been just what our bill said, the rest was for the land. So, now to find out what we could do to get reimbersed for the extra taxes we paid to the park.

Our paperwork from the sale of the property didn't mention taxes at all, as they were supposed to 'look into' what the taxes were exactly, and let us know.. It was just an oral agreement. to pay them a set amount monthly for taxes on a seperate check marked taxes, which we have been doing. Nothing on paper.That was 5 years ago, and they never did let us know, despite us asking them to look into it repeatedly, they always had excuses as to why they didn't have the info yet. The main one being that the new office people didn't know about it.. And it seemed like there was new office help every other month.

Here in Texas we have several tax bills which are required to be paid. Was your contract specified where the tax money was paid to? That may resolve the issues, or contact the city/county ask. Your purchase contract SHOULD specify the terms.

FIRST ANSWER

I'm not a lawyer, so this isn't legal advice. For legal advice, you need a lawyer. However...

First, is the tax on the pad--on the land that you're renting--or on the mobile home?

If it's on the pad, check the pad rental agreement. What, specifically, are you responsible for? If the agreement specifies that you're responsible for the taxes (without specifying an amount), then it could be argued that you're responsible only for the actual taxes. However, it it reads something like, "pad rental fee of $400 a month, to include taxes," then--without the number being broken out separately, you're responsible for the dollar amount, regardless of what you might have been told the taxes were.

Now, on top of that, typically the owner of the land pays the taxes. Just as the owner of a house is responsible for the taxes. You're renting a space from the park owners, just as a renter rents a house from an owner. It would be unusual to require a renter to pay property taxes on the property he's renting, though everything's negotiable.

Or...are you paying taxes on the home itself? If the owners transferred the title to you, then you'd pay the taxes to your city or county government, just as you might pay taxes on an automobile. If the owners didn't transfer the title to you (if you're buying the home on a contract with owner financing), then, again, the owners can charge what they want.

So, if your concern is about the taxes on the land, read your agreement. If your concern also involves taxes on the trailer itself, then the question is: Who is the owner of the trailer?
