House was part of a condo plat that went into foreclosure. Someone bought out the plat but does not own the home we are purchasing. He does own the easement and refuses to grant us use of the easement to access the property. Are there laws in Michigan about any of this?
You need a real estate attorney. I am not an attorney, but believe Michigan law says that the property split/sale that "created" the land locked situation must give an easment for egress. Again I am NOT an attorney, get one.
In Michigan, YES it IS possible to purchase landlocked property. Hopefully your agent had a safety net in the contract allowing you the option to terminate in such a position. Please keep us posted, and I wish you well.
Leah,
There are a few Attorneys I can recomend from the St. Joseph area. Mark Miller, Sally Taylor, or Howard Kahne. All very well respected Real Estate Attorneys, and nice people too.
Because of the past recorded covenants that should have been in place, there still should be some unit owner rights. May be something to stay out of, unless you are prepared to research and defend your rights as an owner.
Paul
I would suggest you get an attorney asap. In my state you can't sell a home that's landlocked. This sounds like a tangled mess that could take a lot of time and money to untangle.
