We are pre-approved for a loan and told the lender to lock-in the rate. We are having problem with their

loan processor. They already sent us the loan application but had not sign yet. Can we leave them and go to another lender? Will we be penalized or pay a fee for doing so?

Hi Gary,

Like what was already mentioned, you're never locked into a lender. I work in Roswell and have a great lender there that has been johhny-on-the-spot with my clients. All of them have loved him! Call or email me for his info.

I'm guessing you don't have an agent since if you did you would have asked them this question. I would be more than happy to assist you with your purchase. Remember...a buyers agent is a FREE service that the seller has already agreed to pay for in their listing agreement. :)

Gary,
You are never committed to a lender until the loan funds. The package that you recieved was just an initial RESPA disclosure package.
I would also be careful when using a realtors "choice" lender. Not to insinuate that there is widespread wrong doing but you want to keep everyone honest.

I have a lender that actually has a programmed called "lock -n- shop" which means they can actually lock a rate for 30 days prior to you having a sales contract on a home. They are the only lender I know that can do this. There is no penalty for not doing business with a lender if you don't want to. If you had a specific home and they ordered an appraisal you would be out that fee if you already paid for it and it was completed. Contact me and I can give you my lender's number. If you are already working with an agent, this is not an attempt to solicit your business. If you do not have an agency relationship with an agent I would love to help you find your next home and negotiate a sale and guide you through the entire process.

FIRST ANSWER

If you haven't paid them anything, I can't see how you would be penalized. The only up front cost is usually for the appraisal. So, unless that has been ordered, I would think you could change lenders without worry. Obviously, I'm basing this on just the info you provided.

You should consult your agent or whomever referred you to that lender. They might be able to get your problem/concerns solved and save you the time an energy of having to start over. That's what I would do for my client.
