We are buying a home, but the listing agent is not cooperating. It has been 3 weeks and we still haven't received any disclosures. My agent has

called and emailed but haven't received anything. Is there anything that we can do? Isn't there a law that the listing agent has to abide by? We really want the house and do not want to back out

You need to speak further with your agent about what he/she is doing to obtain the disclosures and why he/she has not been successful. Has he/she contacted the listing agents' broker? Rather than ask those of us on Trulia.com, who don't know the circumstances of your purchase transaction, ask your agent. And, if he/ she can't explain it, call your agents' broker.

This sounds like a short sale or bank owned property. These transactions take a great deal of patience. I completed one a couple of months ago where there was an all cash offer, price agreed to, and it took 4 months to get the bank to the closing table. If it's a great deal, and you can be patient, it may be worth it. If you want to be able to count on the dates, it may be a very difficult road.

Your agent should know if the property is a short sale or foreclosure / bank owned property. If so, they may be doing everything possible.

If you are not sure of the circumstances, ask your agent to get their broker involved. The broker should be able to contact the listing broker and understand the issue quickly.

Are you trying to buy a short sale property?

If yes, please be aware that the listing agent has to negociate with the bank on behalf of the sellers and it can take quite a bit of time. Nevertheless, reardless of the kind of transaction you are involved in, the listing agent should always inform your agent of what is going on and answer his/her requests.

Another option would be to ask your agent to have his/her broker call directly the listing agent'sbroker to find out what is going on.
