Once title commitment is received, would there be associated costs to move to a different title company?

I've got a home under contract and am experiencing problems with the title company, they just provided title commitment but I want to move to a different title company, the seller is fine with this, but are there any costs to move?

I agree with all of the answers below. As a lender, I can testify to the difficulties in mortgage processing caused by government "improvements". Any changes this late in the game will do nothing but complicate and stretch out the drive to the final closing date. What does your Realtor suggest?

There should be no costs unless the title company has ordered a survey or HOA documents that were part of your expenses contractually.

If you change escrow agents, make sure you amend the contract to reflect the new title company. You may also need to change the closing date as well to allow the new title company to get the new commitment to you. There are additional contractual issues you would want to address if you make this change though.

The new title company would likely need to do a new title search.

Probably no charge in most cases, but they've done some work and gone to some expense now, so I think it would be fair to pay them something. No idea what is fair, as I have never done this or had a customer do this.

I'd ask the escrow officer you are working with.

Also remember the title company is specified in the contract, so you would likely need the agreement of both parties to change.

Typically no HOWEVER MOST title companies are all the same . If your not familiar with alllllllllllllllllllllllllllllllllllllllllllllll the works that is entailed for the title company to work on behalf of you, seller mortgage company, your mortgage broker, Realtors, State/ City laws/, title search , survey, HOA's, insurance, home warranty etc etc etc etc etc etc publish all in one document for date of closing.

NOTE: Some real estate transactions go smoothly others can have issues. You don't work for the title company do you know why there was a delay. Perhaps they had to wait for a party to respond to their inquiry and demands.

There could be issues that would apply to the transaction, irrespective of which title company is handling it. Without knowing the details, making such a change might not resolve your concerns ... there are speed bumps in just about every transaction. Unless you're dead-set on switching companies, I'd stick it out ... if all is as represented, the sale will close, and you'll never have to deal with them again. Just concentrate on enjoying your new home ... best of luck.

I agree with Tim, why switch this late in the game, but you and/or your Buyer's Agent really should ask to speak with the Branch Manager. You can always file a formal complaint later. The state has strict guidelines for all title companies.

I have never had problems with any of the Title companies in Houston, but as along as all parties (buyers, lenders, sellers) do their due diligence, then no problems should arise unless there is a cloud on the title of the subject property.

If a Seller has already pre-opened title on their property, then whatever title problems should have been handled already.

No, there shouldn't be, but you may experience a delay in closing if it is imminent.

It seems pointless at this stage of the game and you are just upset or mad about how you were treated. Let it roll off and close the deal and be done with it.
