owner on the title with his father. Can my husband buy the house even though his name is already on the title?

FIRST ANSWER

The answer is Yes. To be quite candid, your husband already Owns the house if he is on title as either a joint tenancy or tenants in comman. Your father cannot sell to someone else without your husband signing on the dotted line along side him. The exception to this is if they are tenants in comman in which case the father can sell his half, but that does not do anyone any good.

So yes, get Dad and Husband together and work a fair and win/win scenerio for both. If you need any help, give us a call!
