FIRST ANSWER

Hire a real estate attorney to consult with and be careful.Your payments should be made directly to the lender and not the individual. One way to do this is to use a third party source that will also build your credit like Virginmoney.com
If you cant buy at the end typically you forfeit the down payment. Get into a good credit couseling program.
