Would he be considered a first time home buyer? His name is not on the deed to my property, or the mortgage.
He's not eligible for the First Time Home Buyers Program. Period.
See scenario 4 from the IRS link.

good evening.......i have nothing more to ad to the below listed comment other than take an origonal copy of your deceased husband's death certificate to the register of deeds in the county where your home is located and record it....and pay the recording fee....i assume you held title joint rights of survivorship.......best regards..bob mcclure- success mortgage partners- plymouth, michigan.....
Even if his name is not on the deed, your current husband has dower rights by Ohio state law. Than means he owns 1/3 of your home. In fact, you could not even sell it without his signature. Therefore, he is not eligible for the first time homebuyer's tax credit. That question and answer and many other can be seen at http://www.buynowfreemoney.com/1268
