credit since we are not married and would be buying together how would we file to get the tax credit.. We both make less than the 75,000 and not more than 150,000 but we will not be married when we file next year to file as one married couple. Can we still get it if we buy together or should just one of us buy? Thanks

I just wanted to encourage you to hire a Realtor to work for YOU as a buyer's agent. It will cost you nothing (since typically the seller pays ALL Realtor commissions) but will -- without a doubt -- save you time and money! The homebuying process can be complex...and, let's face it: it's probably THE most investment you will ever make. I always recommend that people interview 2-3 Realtors...and ultimately choose the Realtor who you feel is experienced, honest and who truly has YOUR interests ahead of anything else. (Prior to entering the real estate industry, I was a practicing attorney.....my clients appreciate my unique insight when putting together the agreement of sale and negotiating a transaction:)

By now you've read plenty of responses to your question. Let's go find a house for you. We'll figure out how you get your credit, but first we need to find you a place to live that you're happy with. As far as the wording in the tax code goes you both should be able to receive your share of the credit. If you do your taxes on your own this might be the time to check with a tax professional that can tell you how you both will need to structure your returns next year. If one of you buys would you still qualify for a loan for the size house that you want to buy? Since you will be married in the furture you are more likely than not going to want to have both of your names on the deed to the house, so unless you make changes after the fact by adding one or the other to the deed, it makes sense to buy it together now and just both be named on the deed at the purchase. This is from the IRS form 5405 " If two or more unmarried individuals buy a main home, they can allocate the credit among the individual owners using any reasonable method. The total amount allocated cannot exceed the smaller of $7,500 ($8,000 if you purchased your home in 2009) or 10% of the purchase price."
"Note: A reasonable method is any method that does not allocate all or part of the credit to a co-owner who is not eligible to clain that part of the credit."
So according to the form, you can buy together though not married yet. Hope this helps!
