Lead Paint Disclosure Form: When should a potential buyer sign this document?

Before the purchaser becomes obligated under any contract ; the purchaser is the last person to sign and date the disclosure form.

I have the buyer sign it after the seller signs and initials the appropriate lines. It should be completed with the purchase contract and noted as an addendum to the contract.

I have my purchaser sign the Lead Base Paint Disclosure when an offer is being made. The purchaser has a 10 day opportunity to conduct an inspection for lead base paint and or lead base paint hazards.

As the seller the lead paint should be signed along the listing agreement; as the buyer it should be signed once you have an agreement to purchase and before contract; lead paint disclosure applies to residentail properties built before 1978. Your attorney may also have his/her own lead paint form to be included in the contract.

In NJ, the seller is supposed to sign and initial the form at the time they list their home. It should be on file with the listing office.

The buyer initials, signs and receives the pamphlet on Lead Based Paint at the time they sign the contract with their offer..
In NJ, we start off with signed contracts, so that part might be a bit different in NY.
