Last months rent on an auctioned off house??

Asked by Joi Strong, Homestead, FL Sun Mar 17, 2013

We found out in late Feb that the house we are renting is being put up for auction on April 4th, so we told the landlord that March would be our last month. We already found a new place but can't move in til the 6th of April :/, but now the landlord is telling us that we still have to pay March's rent but when we moved in we paid first and last, so we feel like March is the last month, however I'm not sure about us being in limbo for a couple of days.

Technically you should pay March rent, and technically your landlord should return your security deposit once you move out. Your contract is with the landlord until such time the bank forecloses and records new ownership. From that date forward, your rent shall be paid to the new owner.

Assuming it forecloses on the 4th as scheduled, you will have plenty of time to move out (30 days +).
Since you will be the tenant at the time of foreclosure, you may want to consider requesting "cash for keys" from the bank. This type of agreement allows you a cash move out allowance and time in the property in exchange for your cooperation in leaving the place in clean condition with no trash or personal belongings left behind.

There are additional rights you have as a tenant, however, since you are moving out April 6th anyways,it may not be worth discussing.

Good luck and buy as soon as you can!

I think you really need to look at what is in writing. If you have a lease or rental contract in effect, that is still the source for what can and can't be done.
