Is a seller's agent required to consider all offers for a home? My fiance and I found the perfect

house...submitted an offer and the seller came back and said that they accepted an offer from another buyer..they wouldn't even accept a contigency offer for us..even when we said that we would pay asking price..

Once a seller has accepted an offer regardless of price unless something causes that transaction not to take place. That home will be sold to the buyers contract that was accepted. However your Realtor can always submit a back up offer on the property. In the mean time keep looking. We have lots of inventory

I don't know your total situation, so I'll just focus on what you said.

If you are a serious buyer, than making an offer with a contingency of selling your home is a BIG negative, as you just learned.

My advice is to make sure that you, your Realtor, and any other party on YOUR side, like your lender, are all ready to go to bat for you to present the BEST offer. Making an offer with a sale contingency is, in most cases, a WEAK offer compared to offers without contingencies.

It depends, if the seller already executed another offer prior to her getting your offer then they cannot accept your offer. However, did you ask if you can write up a back up offer if things fall through? Was the property bank owned?

I am so sorry to hear you just missed out. First of all just remember you cannot force a seller to sell. The agent or relo company has nothing to say here, it is the sellers choice. As long as the seller is making his/her decision in a legal ethical way and not breaking any laws here they can sell to whomever they wish to even if it appears to be a lesser offer. They can also choose not to accept any other offers (too stressful perhaps or maybe they have it written into their contract).

I would just ask your agent to keep an eye out and perhaps keep in contact with the list agent in the event this offer does not close for some reason. In the meantime, get going at looking at other homes. In 10 years as a Realtor I have NEVER had a buyer that lost a home sale opportunity to go on to the next home sale opportunity and tell me that the home they lost was better. You will always find something better along the way, since you now know what you are looking for and it becomes easiser the second and even third time along.

I know it sounds like a cliche but you will find your dream home just keep looking. I always advise my Buyers that if they really have to work so hard for a contract/sale it may not be the right situation/home for them. It should be an easy and joyful process! Stress free ,too! Hello again Chad,

I now see what is going on... Relocation companies usually deal with one offer at a time, I am not sure why, you would think that they would entertain all offers... especially full priced offers! Who has your Agent communicated with? Do they have it in writing that the Seller will not accept any other offers? You may want to ask this last question to your agent, I certainly would ask a few questions....

First of all we are not dealing with a normal seller...we are dealing with a relocation agent here. The seller was relocated and from what I can gather a third party has been put in charge of selling the house. The seller has been dealing with this paticular buyer for a couple of days...offers have gone back and forth and he buyer finally opted out...saying that they couldn't afford what the seller was asking for...we submitted our offer the same day as this buyer came back and finally accepted the sellers final counter offer...our realtor told us that this seller would not consider our offer even if it was higher...we are willing to pay asking price we want this house so bad. You would think that the seller would at least entertain our offer...

Sorry this deal did not work out for you. The Seller's agent can usually submit all offers to the seller until closing, however the Seller can put in writing that they do not want to consider any other offers, the Seller has the final say on this, if this is the case the agent does not need to present the offer to the seller.

I do hope that when you do find your home that the Seller of the home you find will not entertain other offers too!!

Hi Chad,
Seller agent is required to present all offer in a fair, timely fashion. This is Florida law that comes off the Ethics code 1-6

Standard of Practice 1-6

REALTORS® shall submit offers and counter-offers objectively and as quickly as possible. (Adopted 1/93, Amended 1/95)

Buyers can do as they wish. If they don't want to accept back up offers, they don't have to. There is no law that forces them to act in any way. It is their property and they can conduct business in any legal manner, and accepting a offer, and not wanting others is perfectly legal.

First of all a seller's agent does not consider any offers for a Seller, only the seller makes that decission! It sounds like what happened is the home was already under contract, maybe by only a few seconds but once an offer has been made and presented to the seller and the seller accepts that offer and that message is relayed back to the buyer then at that moment a verbal contract is formed. Chad--Seller's have the right to accept any offer, and an offer has many factors, financing, buyer's closing costs, closing date, etc. By contingency do you mean back up offer in case the first offer does not close?
