As the tax credit is written at this time, you must be moved in to the property on or before December 1st, 2009. Even if you did a one time close construction loan you still would not qualify for the tax credit. I would ask the builder if they have a spec home already being built in that neighborhood that could possibly work for you. Just a suggestion.

As it stand right now you must settle by Dec 1, 2009 to qualitly for the $8,000. tax credit, unless the goverment extends the dead line.

FIRST ANSWER

the house must be primary residence, and the settlement must be done before December 1, 2009, so if you are not settling until January, then no, it would not qualify
