There are many factors involved that make each transaction unique, not the least of which is the contract of sale and its specific terms. That having been said, in direct response to your question: there is no "set" time for requesting your down payment to be returned.

You can ask anytime you want but it doesn't mean they will just give it back to you. You need to discuss this with your attorney right away and find out what your rights are based on the verbiage in the contract of sale that you signed. We cannot give you an answer because all contracts are worded differently and usually address these sort of things. Speak to your lawyer.
