I signed a pre-construction contract Dec. 2006 for a loft. Builder has stalled: sales staff sends out

notices about mass closing, closing in 60 days etc. and the time just keeps going. Builder now says general contractor has defaulted and another will be hired. I have also been denied 2 mortgage loans because of low pre-sale % even though I have 1/2 down. How do I get out of this nightmare without going to court?

One of my friends sons also contracted to purchase one of the lofts, but he got out of the contract. As far as I know the contract is only good for a certain amount of time; therefore, they defaulted their contract. I am not sure if he lost money on it or not, but they have had more and more excuses since day one. There has been some talk about them renting them as Section 8 housing. You may want to contact a real estate broker, maybe Century 21 Olsick and ask how long contracts go for. I will email my friend to find out more about what her son did.

Do you have your own real estate attorney? If so, get them on it---if not get yourself one --NOW---many developments are going "belly up"---if you need a referral email me.

Read your contract about your "out option" realtor cant state anything for we dont have the contract to read, where is your realtor and their suggestions?
