You could probably get out,why wouldnt you just have the builder medigate radon down to 4.0 If there is alot os shale in the ground,this will cause to go wat up as well.So you may run into high #'s in that whole area.Now maybe you'll get with a Realtor.

You need to read your contract, and check with an attorney.

Here, if the radon reading is above 4.0, usually the contract states the buyer has the right to cancel the deal, even if the seller is willing to remediate.

How high was your reading? To get a "true" reading, many experts suggest having readings done several times throughout the year . Once a home is remediated for radon, you really have nothing to worry about. It's a very easy fix, and only requires installation of a fan and some pvc piping to direxct any radon out of the basement. The person who wil handle it, will retest to make sure the readings are within an acceptable range.

Developer and builder contrcts often have different terms than we normally see in standard State Board approved purchase agreements, so depending on how your sales contract is worded, you may or may not have an easy time trying to extricate yourself from the sale. Most of the time, an inspection issue can be ground for terminating the contract, but only a qualified real estate or contract attorney will be able to advise you properly on your options in this particular transaction.

Take a few minutes to find a qualified attorney (or speak with your Realtor to get the names of attorneys in your area) before deciding what you might want to do next.
