I recently purchased a home in sierra madre, california via a gift of equity through a normal escow sale from

my uncle. No agents were involved. We never made any sort of lease agreement for him to stay. He refuses to vacate the property now. I served him a 3 day notice to quit about a month ago. It has been 3 months since I closed escrow. I want to know the process for eviction in this case. I plan to file an unlawful detainer, but I don't want to make any mistakes. I have heard that he is a previous owner in a holdout after the sale. Not a common situation. Any advice?

I suggest you retain a real estate attorney.
