I put in full price offer on short sale, & asked for up to $10,000. in closing costs. listing agent said no

before offer even went to bank. Also they have electric & water turned off & we asked to have turned on until decision made by bank. She said she would turn on for inspection only. ISN'T SHE BEING UNREASONONABLE? WHAT IS NORM?

Is this a short sale or a foreclosure? Sellers accept or reject offers as they are still the owners on short sale properties - then it gets submitted to the lender who will do the same.

Hi Kathy,
It does not matter what the listing agent may know about a property. All offers regardless of what the agent likes or feels need to be brought to the sellers attention. The seller could turn down an offer today and accept the same offer next week. Most of the time a bank will not turn on the power until the contract is executed. If you make an offer, the agent is duty bound to present it as given and allow the bank to make the decision to accept or not. The fact that they may have turned down a similar offer previously is of no consequence as they can change their guidelines at any time. As for the utilities, if the house is winterized they will only dewinterize for the inspection and in some cases only after fully executed contracts. Some banks will dewinterize and winterize but at the buyer's expense. There are no hard and fast rules.

FIRST ANSWER

Sounds like the listing agent knew that the bank would not consider such an offer and did not want to waste the time. Since it was the lisitng agent, they may have had other offers that where superior to yours. I have seen forclosures where they would not consider anything but cash. Often it is because of the condition of the house. In your case it may also have been an appraisal issue. Sorry for your disappointment. By law they do need to present all offers even if they feel it is a waste of time. Good luck in the future. If you are considering a home in the Orange County, Ny area give me a call.
