There wasn't any good reason for the delay. We were told that it would take around 6 months to build, after 6 months all that was built was the foundation and that was poured only after much pushing by us, nothing else has been done since. We recently were told by more than 1 source (our contact with the builder was one of them) that this well known Houston builder is putting others in the same situation because they're having issues with material suppliers over money. It's not our fault that they aren't paying their bills. We need our earnest money, upgrade money and contingency fee returned so we can purchase an inventory home from another builder. Time is short because we already sold our home 3 1/2 months ago and are in a leaseback contract until mid October. We were forced to cancel our contract 3 weeks ago. It has become apparent that the builder was having problems when we signed our contract, they took our money and have left us hanging. What can we do?
