Hi Devonus,

If you have closed and funded then it should be up to you. HOWEVER, check with the city of College Station. You must have a permit to have the pods out in the front yard if you're withing the city limits.

You need resolve those issues WHO owns the home? Money & title transferred in your name , and seller is paying you rent daily till they close? If so you own property you can do anything you want to HOWEVER confirm via HOA what are limitations, and number of days for pods remain.

IF TITLE not in your name you need seller approval.

Do you have a lease with the tenant? You will need to check the lease.
I think you can also discuss with the tenant.
In this case I think you are accommodating to let them stay after closing, perhaps they can also be accommodating to let you have a pod there.
Will the pod be safe?

In the contract that you signed was there a move out clause? If it specifically said they had to vacate the property by a certain date I would simply tell them this: You sold me the house. I need to move in and you need to move out. If you do not I will withdraw my offer based on breachof contract.

Remember, you can get a short term rental somewhere or other. So can they. SInce it is your house now I would insist they move immediately.

Also, since you legally have title now it IS YOUR place. So you should be able to put anything you want on YOUR property.

The only exception would be if in the contract they said they would stay until such a date. But once closed it should be your property free and clear of tenants. And as you have tenants now make sure you charge them a large weekly rental fee. Preferably going up by $100 each week they remain. Otherwise it seems to me that you have squatters living illegally on your property.

Ask your realtor why the previous owner can occupy your house. Ask the realtor how you can get rid of these illegal tenants. Not being mean, but when I buy a house and it is agreed that I pay and it is mine on a certain date I want the old people gone that exact moment. If I sold my place and did not have a replacement house I woudl live in a cheap hotel for awhile until I did.

That is a question between you and the seller of the home that you just purchased. Hopefully, you have a temporary lease agreement for the seller of the home, but you should definitely discuss this with them. Congratulations on your new purchase!
