I just bought a new home in my name. My boyfriend moved in with me and pays the mortgage and also has the light bill in his name. We are breakingup , does he have any rights to the property? can he take me to court??
Cindy
The only people that should be advising you should have access to the documents (title, deed, mortgage). If you have genuine concerns a Real Estate Attorney would be the best person to advise you.
I do not know all of the facts, nor your circumstances. However, you should be aware that things are often not as they first appear, so the only way to get the "right" advice is to look at the facts. Even with facts, attorneys can sometimes make you life miserable...so get the facts, think through your options.
Good luck.
I'm sorry to hear about you situatons. If your purchased the home in your name only, and financed in your name only you should be ok. I would contact a lawyer just in case. If you need the name of a lawyer feel free to call or email me. You can reach me at my web site http://www.sandymecca.com
Cindy,
We are sorry to ear about your situation. In situations like these, it is always best to consult an attorney for their opinion.
Best wishes,
The Eckler team
Is his name on title to the property? If yes, then he does have rights. If no, then he doesn't.
Also, how long has been paying the mortgage and how much ... did he pay the full mortgage or half or just 1/4? Real estate laws are different in each state. In certain states, there is recourse if the individual has demonstrated/established responsibilities to the assets i.e., payment made for X period of time.
Please contact a local agent and lawyer to help you with local real estate laws.
