On your divorce pay close attention to the divorce decree. This is often where credit gets messed up. For instance the decree might say your ex-husband is responsible for payment but if you co-signed or are on the account jointly your credit will be impacted as the creditors will come to you if he isn't paying regardless of the decree.
You might want to rent awhile and save the money or do a home purchase straight out. What you have to watch out for is a seller holding earnest money,security deposit,or option money. Many places you will lease you run the risk of the owner bailing,taking your down payment,and the property forecloses. This is why you need a professional to protect you when it comes down to it.
With a lease purchase you then tenant create a beneficial interest in the property and have a security deposit and are required to purchase by a certain date and time.
With a lease option you have the option to buy but are not required to and usually you have no beneficial interest in the property. Sellers like lease options because they usually take the money and spend right away and if you stop paying evict you and lease up again (kind of like repo-ing cars but houses instead. The lease agreement and purchase agreement will be 2 seperate documents.
Usually it's best to have some of your payment applied to the purchase price. For example 1,000 a month payment 400.00 per month goes toward the purchase price at closing. You also have to make sure in a declining market that the property will appraise when it comes time to purchase and if not you have the right to get your deposit back to purchase properties at current market value.
I never let the sellers hold earnest money,security deposit,or option money. The reason is even if you are due the money per the contract getting it back is an entirely different story. You could have to take them to court,go through arbitration etc.
If you received a lot of settlement money we really need to talk as this is just not about a home purchase but making sure you do the right thing with wealth preservation. If you don't have a plan the money will be gone before you know it.
