doesn't have time to show me, or there is already a contract. Can I switch to another agent, and if so, do I have to tell the first one to stop sending me listings so that she has no claim on any commission? Does just sending me a listing cause her to have a claim on any listing she sends to me via email?
Austinhomeseeker-Is it possible that the homes you have been interested in are in a popular area? Some areas move quickly, while others sit for awhile.
Rodney is absolutely correct. If you have not signed a Buyer Representation Agreement, you do not have an agent. You are not obligated, nor are they obligated to you. However, if they have showed you a home or two and you happen to buy that one, it could get sticky for you.
You can certainly click on "unsubscribe" which will discontinue the notifications. However, this does not solve your home search issues. Jackie suggested that you speak with a lender (bank or a mortgage broker) to get pre-approved. She is dead on with that. This helps you greatly, and is really your first step. They will tell you what loan program would be best for your financial situation and how much you are approved for.
Please feel free to let me know if I can help you further.
Have a great day!
Just sending you listings without an agreement does not constitute representation. In order to be represented, the agent should have had you sign both "Information about Brokerage Services" and a "Representation Agreement". If you have not signed either of these, and you want to no longer be affiliated with the agent, there should be an unsubscribe link on the searches you are recieving, or just call or email the agent to ask them to stop.
However, if you have signed an agreement with them, I would recommend first asking them to be released, and if that does not do it, you can place a call to their broker.
I would be glad to help you out with any other questions, or your home search here in Hays.

I agree with Lewis on this. If you don't want to receive listings from this agent, there should be an OPT OUT or UNSUBSCRIBE link you can access to get off of the mailing lists.
Have you already been prequalified for a loan? If not, you should go ahead and do this. Most agents will not show you homes if you have not been prequalified. Prequalification for a loan shows the agent that you are serious about purchasing, and not just wasting their time. If you need help with the process tell your agent. They will be glad to assist you. Good luck!
Jackie
If you are unhappy with your current agent you should find another agent. Just emailing listings probably does not trigger the issue of "procuring cause" which is the determining factor as to which agent is entitled to a commission. If that agent has physically shown you a home that you contract for and done all or some of the other duties required of an agent in obtaining that contract then yes the agent is probably entitled to the commission.
