home next spring (possibly to a family member). I am trying to test the water on what is available in a few different areas that will suit our needs. I recently found 1 property that fits our needs perfectly. I am not ready at this time to make an offer, I will be ready my next April-May though. My question is, If I was to have a Realtor show me the home now would the seller be obligated to any commissions if I didn't make any offer now? Let's just say for example the home didn't sell and was off the market by the end of this year. Next spring I made an offer and consummated a deal with the seller, Would the Realtor that hosted the open house or one that showed me the home initially be able to force the seller or myself to pay any commissions ? I would love to view the home to see if it is really what I think it is now. I don't want to be obligated to anything just yet. Thanks for your input.
Brian, Why are you concerned with the payment of commissions that will be made by the seller?
We do not earn commissions by holding open houses, we earn them by putting together a buyer and a seller, by being the nucleus of a cell that brings all the parts together into agreement that consummates into a transaction. This is how I put food on my table to feed my family.
Would you be comfortable working all week and your employer telling you at the end of the week, sorry...I found a way out of paying you your salary for this week?
I am representing an incredible B&B on the water in LI...it has a wonderful income and would be a fabulous place for a family to reside. Now that I know your first priority is to find a way to gyp me out of my livelihood, please do not contact me to learn about this opportunity.

If you would like to purchase a B&B your best bet is to speak to a realtor. Explain that you are looking to purchase a B&B in the Spring of 2010. The realtor can explain the process of purchasing Real Estate in NYS. A buyer's agent is able to prepare a market analysis on the property that you intend to purchase and put an offer on. That way you will know the market value of the property. Also, sellers usually put their property on the market with the intention of selling it, so most of the properties that are on the market now will not be on the market in the spring. It is best to start looking for a property after all of your ducks are in row.
Gail, I don't need you or any other realtor to make a simple real estate transaction for me. Why should I pay you or someone else 70K (7% Commision on 1M) to fax some documents back and forth? The internet is rapidly sending real estate brokers and agents to the brink of Extinction. I Will go around the broker on this for the same reason you would go to a car dealer and negotiate a discount off of the dealer's invoice on your BMW. Money . I have the 70K but I am surely not going to give it to a real estate broker for what I can do myself. The money I save will pay the property taxes for 3 years.
In New York....the agent who puts in the signed offer is the agent who receives commission. If the B&B is listed with an agent, there is already commission established...buyer does not pay directly.
I have a 17-Room Victorian on the water in Long Island. If you purchase it after my listing runs out, but I have introduced you to the property, the seller is still obligated to pay me.
We make our livings in real estate; why are you trying to inhibit our feeding our families and paying our mortgages; are we not entitled to make a living? Realtors spend years studying and continuing to be educated to protect both the sellers and YOU the consumer.
You should be paying us double for the services we provide, not be looking for a way for us to do the work and you to go behind our backs.

Many real estate professionals work with customers for a period of years prior to making a sale...agents understand there are very different levels of motivation from one buyer to another.
Our recommendation is to begin your search process by collecting information via the internet and attending open houses. Be up front with the agents you come in contact with making them aware of your timeline. Many buyer find the agent that they decide to work with through attending open houses.
