I am buying a home and it will close in dec, but my apt lease is not up till the end of january. is there a?

early termination due to buying a home in colorado.

There are no laws that allow you to end a lease in favor of closing on a home. A lease is a legal document that will hold you responsible for the execution of it's terms.

You might be able to help the landlord out by finding a suitable replacement for your apt. If you can do that, the landlord legally cannot charge both you and a new tenant for the same time the apt. is being rented.

You have already negotiated a deal on your new place. Sometimes the seller will help you with your lease in order to make it easier for you to close on his home. This of course would not work now, but might be of interest to you or others who appreciate your question.

There are many ways to negotiate buying and selling a property. That is why it is important to use an experienced agent who can look out for your welfare.

The only other way out I can see is if you or your landlord find a tenant to take your place right after you move out. With a slower housing market, hopefully rental market is hotter. The other problem is it usually take a few days after a tenant moved out for the landlord to clean up the place for the next tenant.

Most of the landlord will not take double rents. But you will have to read your contract and talk to the landlord to find out.

Great first answer. Go with that advice.

To my knowledge there is no law that provides for early termination and unless your lease provides for early termination for this reason then the answer is most likely no. Although, you could discuss this with the landlord and see what happens, but don't be surprised if the landlord expects you to adhere to the terms of the lease.

Have an attorney review your lease if you are not clear on the terms.

Joe, Although I am familiar with CO laws, I would advise you to read your lease. That answer will be there. They may also require a 60 day notice instead of the 30 day.

Your lender probably told you this but since you're closing in December, your first monthly payment on your house will not be until February 1st so I least you will not be stuck with 2 payments.
