How can I get my earnest money back after I cancel a short sale contract?

I was in a short sale contract but I cancel the contract since I never heard back from the bank approval for 4 month. Now the seller does not want to sign the waiver to relase by deposit money . What can i do to get my money back, since it was not accepted by the bank, is the contract still valid?

FIRST ANSWER

If you have a lawyer ask him or her what she or he advises. It is always good to have a lawyer in these cases when something like this occures. Being a Realtor I cannot advise on this because this is a lawyer question. I am sorry I cannot help you any further Phyllis (BAIRD & WARNER
