The tax credit is available on a nationwide basis. The rules apply to any state that you currently own, or have owned a home in and that you have resided in for the past 3 years. If you have not owned a primary residence in the past 3 years then you should qualify. Trying to play the 2nd home., part-time residence, vacation home card will require the advice of a tax accountant but if any of these are the case I believe you will not qualify if any or all have been used as a personal residence for any portion of the past 3 years. Get the accountant's advice.

Do you still own this property in another state that you purchased 4 yrs ago? If so you would not qualify. You cannot own a property within the previous 3 years regardless of the state it is in. So if you are moving to a new state and this other property has been your principal residence for the last 4 years then no, but if you sold that other home 4 years ago then you should qualify. Best bet is to always talk to your account/financial advisor/attorney and they can advise accordingly.

The answer depends on how long ago you owne the property. This is a link to the IRS website which goes through a number of scenarios and may be helpful. Technically, if you have not purchased a home in the last 3 years your are qualified for the credit regardless of where you are moving from.

Dear Static0079,

You have many requirements to qualify for the first time buyer. The issue you are referring to is that you have not owned a home in the past three years. You should qualify if it has indeed been four years.
