emailed and called the CPH office in California (I think)and they will give me no info. How would a CPH warranty work on a resold home? I am considering buying a resale CPH, but if I can't get answers now then what would happen after I bought the home. Please someone direct me to an article that explains why they left. I've been told that they're previous work is still better than any new Kb home.

Depending on the warranty it should part of it will transfer with the sale. You would just have to make sure you get a copy of that contract.
Also, you can get a Home Warranty when you buy the home and this will help protect you for a year, until you need to renew.
I used to work for KB and they build a good home. The same people who build KB homes build all the other homes in the area. The difference is the builders managers. If they don't do their job you can see it in the finally build.

You have asked the question that may buyers of resold new homes are asking. This is what I would recommend. Let's put an offer on the home you would like to purchase. Then, one of the items I strongly recommend is LETS GET A HOME WARRANTY!. This will be some relief that is available to you... only at the time you buy the home. Captital Pacific Holdings, Inc., the parent company of Capital Pacific Homes is widely known to have had some recent financial problems, mostly due to the slowness of the economy. Regarding Texas, they are only in Central Texas and never expanded their operations within the state after starting them here in 2001. After many builders have declared bankruptcy recently (Newmark, Kimball Hill, etc.), I suspect this was a cost-cutting move to keep them for loosing critical cash in a slow time. The remain in Arizona, California and Colorado... Well... Enough said - These are some of the hardest hit states in property values - BUT... I have heard through the grapevine that California is starting to show signs of life again! Good news for everyone! Hope this helps! Steve

CPH is DBA Clark Wilson Homes Inc. out of Austin, TX. The TRCC has their registered contact number as 512-320-8888 and the address as 3809 JUNIPER TRACE RD SUITE 100, Austin, TX 78738. I am not aware of why they might have left, if they did. You can try calling the Texas Residential Construction Commission at 877-651-8722. TRCC licenses and oversees these matters and might have additional information on the builder and the status of any warranties they have issued.
As for the issue of a resale CPH home there is a little understood item regarding the mandatory 10 year warranty program. Any home that is not owner occupied and transferred to a new owner occupier will invalidate the warranty altogether. For example if a currently owned home under the mandatory 10 year warranty is sold to an investor who does not occupy the home (they rent it out say) then the builder is no longer required from that point on to honor the warranty. The same would occur if a home goes REO (foreclosure) the home loses its warranty coverage. Some builders might decide to honor the warranty anyhow but don't count on it. Additionally if a builder declares bankruptcy they can request the bankruptcy judge to release them from any warranty servicing requirements as in a Chapter 11 reorganization.
Try calling TRCC and see if they are aware of any specifics about the builder. Good luck!
