Does an agent have a certain amount of time that they have to present an offer to the seller?

My husband and I put an offer on a house. We paid the 1,000 deposit, provided the preapproval letter, and waited. The seller agent then stated that we needed a DU letter that our preapproval was good enough. We provided that documentation and when that was given to the seller's agent (bank owned) he stated there was another offer coming in on the house. A couple of hours later we received a call that the house was going to an auction site and that our offer was never presented to the seller. I think it is because we asked for money toward closing costs and on the bid site the buyer has to pay all the closing costs. Coincidently the price of the house on the bid site is exactly what we offered. However on the bid site the buyer also has to pay a 2500.00 transaction fee, all closing costs, and try to get in to do an inspection before you bid. We learned that the house will not be dewinterized so we would not be able to do an inspection before we bid on the property.

In Ann Arbor the contracts read time is of the essence. It sounds like the Realtor did present it and it was kicked back for the DU letter. With banks involved it is all about them and their time line. Most banks don't like to give back buyer concessions so it is important to make the offer as clean as you are comfortable with.
