Class action lawsuit,Should we consider buying this house?

Asked by Andy, Fremont, CA Wed Oct 12, 2011

One of the properties that we are interested in has a "class action lawsuit" where the seller (and perhaps other residents in the area) are suing the builder. We got a one-line reference to this in the disclosures, but not much is forthcoming right now.
Any pointers in what to look for in such class action lawsuits? The disclosures came to use fairly late in the game and I am honestly worried if there is something far more serious than a simple "we are suing the builder". Any inputs on what we should be looking out for would be greatly appreciated.

When we enter into a DEAL we look for RED FLAGS:
We take RED FLAGS very seriously.

We also will not offer legal advice; we leave that to the Lawyers.

If you are looking for a HOME for your family; this looks less than ideal.
If you are looking to take advantage of a bad situation for your personal gain; you will have to decide if this is worth it. Only you can decide that.
My opinion is that; If it looks like a skunk, and it smells like a skunk.......

Good luck and may God bless

Before moving forward with this home, you need to find out why there's a lawsuit. Maybe their suing because something is seriously wrong with the construction or maybe the builder promissed to do something and never did it. Bottom line, to make the decision you need to find out why.

Hi Andy,
I would really get clear about what the lawsuit is before you move forward. It makes some difference if the home is a condo/townhome or a single family home, but either one could come back to bite you. Find out what is the problem with the builder and get informed. Buying a home is a very big decision and you don't want to make a mistake.
We wish you the best of luck,
