Hi Patti,
The answer is yes if you are buying it cash at auction on court house footsteps. It will be better for you to let the bank go through its foreclosure process and than buy. FIRST ANSWER

With a notice of default,the owner stilll has the opportunity to redeem the property. it still belongs to the owner as the lender has not yet taken possession.
