Can we put $100 down in earnest and offer $900 in a week if the seller wants to work with us?

We want to put an offer in on a home right away. The house is going for $195K. We plan to offer $190K which we feel is a strong offer. The thing is, we are waiting on a large paycheck to come (should be here in about a week) that we could use as earnest (about $1K). However, we want to start negotiations now and are wondering if we can put down $100 in earnest now and tell the sellers we will put down $900 more in a week if they want to start negotiating w/ us seriously. Is this acceptable?

Hi Jane,

I would suggest that you present a Promissory Note to the Sellers for $1000.00 and have the Promissory Note redeemed or made “Good” when you have the full $1000.00 to give to them.

Sellers are familiar with Promissory Notes and this may be passable. Should you have any further questions don't hesitate to ask.

Are you working with a Realtor?? This is something your Realtor would know and could answer.
You can Place a date in the Contract when the Agreed Earnest Money will be Delivered.

Dear Jane,
You can delay providing earnest money by using the alternative earnest money deadlne in the Colorado buy/sell agreement. For example, you can set the date to provide earnest money as "5 business days following MEC" (Mutual Execution of Contract). Are you working with a Realtor?

Have it written into the offer. That's a fine compromise and it's often used when passing a contingency deadline. An example would be an increase in the earnest after the inspection is completed, so to use it in your example would be fine. Good luck.

FIRST ANSWER

In CA on our forms their is a place for just such a problem. It says "Additional Deposit shall be deposited in escrow within _____days in the amount of_____".
