Did you complete attorney review? When? and When was this check cashed?
A standard NJ contract of sale has a clause that states whether or not there are tenants present in the property the time the contract is written. If there were no tenants, it does not make sense that the owner would rent it while you were "under contract." However, if you were not "under contract" (out of attorney review) the seller may have been advertising for a tenant and put one in there if it was being used as an investment property for the seller. Leases can be written months in advance. As the buyer, you should have been made aware of the lease, though.
Get your attorney involved.
Hi Isabel. Was the property tenant occupied when you signed the Agreement? Is this a change in tenancy? Or, was it vacant when you went under Agreement, and now it is tenant occupied? Are you buying for yourself to live in, or as an investment property? In New Jersey, the tenants rights supercede the change in ownership. Get some legal advice immediately.

Are you the buyer? Is the seller trying to rent the condo instead of selling it to you? Are you working with a Realtor? Do you have a sales contract...or a lawyer representing you?
