Can an HOA require a background check on a buyer of a property?

Based on the information provided in this link from Mass Legal Help it would seem that yes, this would be legal. Check it out... it is full of details and good information regarding a CORI check performed by landlords, housing authorities etc.

I agree, its most likely that an HOA could require this, but check with a competent real estate attorney.

I agree with ch. If you really like this property want to move in these people are going to be your neighbors best to start off on the right foot.

The only time I have ever heard of such a thing is with a Co-Op which is an entirely different legal structure as it is a Corporation. Never have I heard of such a Condo Association requirement. Although then again, criminals are not a protected class. It's a good question.

Within reason I would say yes. What are they asking you for? Understand that the value of your property will also depend on upkeep and maintenance which your association fee covers. Every owner should be concerned.
