Can a refinance be done on sibling buyout if sibling is the Executor?

My sister and I inherited our deceased parent’s paid off home. My sister is the Executor of the will. I would like to buy out my sister’s portion of the house. I am told by a lender that since I already own 50% of the house, they would consider it as a refinance. My sister’s attorney is objecting and saying that can’t be done since my sister is the Executor. What does that have to do with anything? Why should he care how I am obtaining financing to pay my sister her portion? Thanks to all who respond!
