Can I use another broker to negotiate a purchase on a coop apartment after submitting an offer through her?

I began working with a broker who, I believe, does not have my best interest in mind. However, I already placed an offer (verbal only, nothing was signed) on a particular apartment through this broker. (She insisted that the offer be verbal, not in writing. I wasn't comfortable with that. I wanted to put in a written offer) The offer, rather low, was not countered. I no longer want to work with this broker (for many reasons). Can I go to another broker and make another (higher) offer on this same apartment through him/her? Or, am I stuck with the original broker to further negotiate on this apartment?

Why not change Realtors if unsatisfied with the service, interview a few and choose the one you like best; all offers should really be in writing along with a mortgage pre-qualification or pre-approval letter. Verbal offers really have no impact at all, you really need to show you are a serious buyer.

Verbal offers are not offers at all. Write up the offer with a good broker.

Dear Aptbuyer,
We have a saying - a verbal offer is as good as the paper it's written on. Agents get paid when they bring about a meeting of the minds. Apparently this other agent has not achieved this result. If there is no offer in writing, the seller has no idea who you are. Unless you have a written agreement with this agent, you are free to go with whomever you choose who can bring about a meeting of the minds.

With regards to your very first sentence, if you do not have an exclusive buyer's agency agreement in place with this agent, then you should know that she does not have your best interest in mind. Unless otherwise explicity stated, all agents work in the best interest of the seller. By law, the agent should have had you sign a form called the NY State Disclosure Form disclosing who they represent.

A buyer's representative can provide you with a market analysis of any property you are interested in purchasing. This way, you will have all the information you need to make an informed purchase - recent sales, average sale price in the building and the surrounding area, what other units are on the market, and what listings have expired and at what price, how long the average apartment took to sell, etc.

When you're dealing with an experienced agent, all offers are made in writing with a pre-approval letter (if they're really good, they will speak to the lender that issued it as well). Especially in the case of a co-op, the agent should also be able to present other information to the seller - your income, job history, credit score, assets, reserve funds, etc. so that the owner knows that you will have no problems passing the co-op board.

Verbal means Nothing.

You have no offer, you have no contract on the coop apartment.

As for your relationship or obligation to this Real Estate Broker:

If you do not have a signed written Brokerage Agreement with this Real Estate Broker, you are free to go.

If you do have a written agreement, ask them to sign a cancellation.

If they refuse, see an Attorney about getting out of that Agreement.


Also - when you get the New Real Estate Broker, advise her or him that you have worked with the other Broker,
and tell them what properties you have been shown.
