Can I sell my home to my spouse?

My home was purchased prior to my marriage. It's just my name on the mortgage and deed. I can't qualify for a refinance on my own (horrible credit). Can I sell my home to my spouse for market value?

No way dude! Ain't gonna happen! Since Texas is a community property state, it is possible to have your spouse refi the home in her name only if you go Conventional, but her income would have to support it and so would her credit.

I have a feeling you cant. Even it was your own private property prior to your marriage. But any married person to get a loan they need his/her spouse information since it will become community property.

Talk direct to mortgage broker you might be able to refi with his name . No matter what both names will be on title per laws of Texas

You can just do a quick claim deed to get her on the deed and then refinance using both or one of your credits. This was there is no sale and it is a lot cheaper than selling it to her which will incur closing cost plus refinance cost.

You don't need to do that. Just requalify in both names and do a loan in both names or husband only.
Your lender will be able to walk you through the details.

If you have FHA loan you may be able to do a streamline refinance with no credit check.

We just need to get you in front of a good lender who can look at your situation and tell you the best course of action.

Hi chrmdncali5,

You can sell your house to whoever you want to. HOWEVER, if it is going to end up being a Short Sale if you sell it at market value, you cannot sell it to your spouse. Your lender(s) will have you sign an Arms Length Affidavit stating the buyer is not a spouse, family member, etc.
