She went on to tell us how she was planning to buy the property as an investment for herself. After she saw the look of horror on my face, she quickly said "Well, it's not a conflict of interest or anything..I'm just saying that you're making a good investment..." But throughout the process she has done nothing but delay our closing. It caused us to be inconvenienced into living with my parents until we could close because we had rented our previous house already and then the closing was pushed back a month or so because of her client. During the process, we terminated our contract and made a new one [long story] and she told us before talking to the seller that "We could send the new contract, but he wouldn't be signing it." [Which he did..she was trying to scare us off I believe.] It just rubbed me the wrong way and I wanted another opinion on what actions should be taken against this agent. She is manipulative and I don't want this to happen to anyone else.
Hi Holli...
I am not a lawyer, but since you closed, it would be difficult to say that you had been harmed. And the seller's agent was not representing you. Did you have an agent? Your agent should have taken charge and moved things along, and that's where I would be directing my questions.
Disclaimer: This is my opinion only and is not offered as legal advice, Always consult an attorney when you have a legal question.
I did not deal with the agent directly - I went though my agent. We have already closed on the house - This dialogue happened AT closing, and it just rubbed me the wrong way. I felt like maybe she had been trying to scare us away from the house by pushing the closing back so far and by being rude to my agent in general. It's all just ridiculous.
Your buyers agent should have acted to keep your from dealing with the listing agent directly, a good buyer agent would have kept all of this from happening. if you did not have a buyers agent you are on your own but should not be taken advantage off. register your complaint with the listing agents managing broker. you can also get a form from the board of realtors and state real estate commission to file a complaintl, but i would wait until after you close. you can start now with the managing broker. good luck in woking things out
This was the seller's agent, I am the buyer. I had my own agent, but i wasn't aware of the agent's interest in the property until closing. I only knew that our closing kept being delayed and it was not our fault. It just seemed like everything made more sense when she said that she was interested in the house for herself.
Holli,
A lot of agents say they would buy the buyers home at the closing. It sounds like your agent might have been serious.
You can complain to the Broker, but chances are you'd really have to file a complaint with the Georgia Real Estate Commission, if you wanted to do something substantial. Even then, it won't likely stop the agent from doing this again, should it come up.
Your other option is to visit websites and let your opinion be known. As Realtors, we want to be found, but imagine the horror of finding negative feedback should you post it somewhere.
Sounds like a big misunderstanding from this side. Maybe a more thorough interview process on your next Realtor should take place so this is less likely to happen.
Holli,
I am so sorry for this happening to you, and am personally upset when a fellow agent behaves in this manner. Do you know if this agent is a REALTOR by chance? You can certainly file a complaint should you choose to do so.
Are you not represented by your own agent? does not sound like it from the above, this is another reason why it is always best to be represented and to have your interests looked after. It does not cost anything to you as a buyer. I wish you the best and please advise if I can be of further assistance.
