We had an accepted bid on a home about 3 months ago. We did not have the house inspected. We were waiting for more basic info. about the house. The seller's agent had contracts drawn, without our knowledge. This agent claims that the seller had to pay $500 for this to be done. We pulled our bid off the table due to an inability to attain the basic info. we had requested. We're interested in this house again, but the seller's agent told our agent that the seller will not allow us to see his house without making an offer and giving them $1000 binder.We feel the seller's agent is misrepresenting all parties involved. The seller's agent seems to be sabotaging our efforts. Our agents manager became involved, the sellers agents manager became involved. It fell apart. The sellers agent is claining see showed us the house originally and feels our agent is interfearing in the transaction. We found the house on line and called to see it. We had no agent working for us at that time. HELP

Well every states real estate laws vary. In NC the sellers agent is the seller's agent unless you signed an agreement with them asking them to represent you. Otherwise they are acting on behalf of the seller. As far as the earnest money the homeowner needs to be involved but, it is a sticky situation in that your agent cannot approach them while they are under contract. If you have an agent let them handle it. There are ways to work things out and the Brokers in charge should be able to hammer it out.
