The person getting the mortgage claims the tax credit. You must be a first time home buyer, or have not owned a home in the past 3 years. The new tax credit is for individuals or couples who have owned a home 5 consecutive years of the past 8 years. There are alot of outlets right now discussing the tax credit extension, and it has not been signed off by the President yet, but that will most likely happen. It is my understanding that if you are not married then only 1 can file the claim. But please check with your accountant he should be able to qualify this for you.
