how can I get out of my listing contract. My agent is not doing a good job?

She took pictures of my house that were so bad I asked if she would take some more, after waiting 3 weeks I took my own. It was listed 2 months before she had a brokers open. I asked if she would have an Open House, she put up signs when she arrived to have it and the add in the paper didn't have a price or say anything about the house, no picture just the address. What can I do?

I am an agent in Neosho Missouri, If you are unhappy with the agent on your property you must address this right up front with the agent and if you still are satisfied with the outcome talk to the broker of the company and see what can be resolved with this issue. No agent or company wants a unhappy customer. A bad word goes along. Definitely speak up and get the issue resolved - I cant imagine an agent not willing to work out the issues to satisfy his client. There are very strict Realtor guidelines for the agent to follow in satifaction of the client.

Your listing is actually with the broker, not with the agent here in MO, so start by talking to the broker. Most brokers want to keep your business and will work with you to fix the problem. It depends on how the contract you signed is written and the broker. In St Louis, technically, the broker can hold the seller to the contract until it's expiration date, however very few do, since it's bad business. Most will, with a written letter from you, release you from the contract before the expiration date. Talk first, and see if the broker will fix the problem (perhaps assign a new agent?) if not, take with you to the meeting a signed letter stating your reasons why you are breaking the contract and give it to the broker at the end of the meeting if it doesn't go well. If they state that they won't release you and the contract states that they dont' have to release you, your next step would be to go to the local Real Estate Board and talk to them about what the local contract will allow you to do.

Our recommendation is to be direct with the agent and express your concerns to them. Any agent "worth their salt" should be willling to turn back flips to satisfy an unhappy customer.

I'm sure that an honest and open conversation will help to clear the air and give her an opportunity to explain why things are as they are.

As your agreement is most likely with the brokerage,not the individual agent,I would speak with the broker & request a different agent.

FIRST ANSWER

If you are unhappy with your current realtors service, sorry to hear about this, review your listing agreement determine terms and conditions. Most sellers who are unhappy can cancel listing at anytime however requires broker release not the agent.
