I signed new home contract in April 2007 and promised date of delivery was March 2008. Now my builder called me and told that they can not delivery this home in March 2008, they will try there best to deliver in December 2008 or Jan 2009,because they did not get permision from township. They told me that in Pennsylvania they can delay up to 2 years. Now I am asking my money back which is 5 percent of the home price, but Builder is refusing this.. Please help what are my options … Thanks
Is it Ryan Homes by chance? I had the same thing happen with my buyer.Can you say NIGHTMARE.They also refused.
WOW! my guess is the builder is the one who created the contract you signed. Without seeing the contract it is hard to know what liability each party has. I would as a bare minimum have the contract reviewed by a real estate atttorney but i might also be inclined to double check the township in addition.Not getting permits is like forgetting your hammer when you are a builder.....something does not add up!!
