Banks do not usually start foreclosure proceedings on home mortgages if you miss one or two payments. Were you late on your payments several times or maybe behind in your mortgage payments? What I suggest that you do is set up an appointment with a loan officer in the Mortgage Department of the bank that holds the loan on your home, you might be pleasantly surprised. Good Luck!
In general, mortgage companies start foreclosure processes about 3-6 months after the first missed mortgage payment. Late fees are charged after 10-15 days, however most mortgage companies recognize that homeowners may be facing short-term financial hardships. It is extremely important you stay in contact with your lender within the first month after missing a payment. That being said, there is nothing in your loan that would allow your mortgage company to refuse to accept your monthly payments, as long as you are paying the set amount every month and any incur penalties for being late or missed payments. If your mortgage company have started the foreclosure process they will NOT accept your monthly payments. If that is the case then you should seek legal advise.
There are several possibilities. What I would suggest is:
1) Go online to public records and see if there is a legal action posted against your home.
2) Contact your lender. Some times the late payments and/or court fees ad up. Then when you make a payment it could be short. Rather than accepting PARTIAL payments the bank may put the payment into an escrow account. So it is possible your payment went thru but your account was not credited.
If this is the case then you should work something out with the lender OR get a foreclosure attorney in your area.
Most lenders are willing to work with you and if you want to keep your home AND you still have an income you should be able to work things out.
Unknown in Dallas;
how many payments had you missed before you sent in 2 months worth of payments?
have you ever been slow to pay? as in late?
If you are having difficulty keeping track of the time and mailing your payments on time, try setting up automatc payments with your bank.
If you are having difficulty brnging in sufficient income in a timely manner, try calling the bank and explaining the situation. See what they say.
