my house is up for auction on nov 4th. if it sells how much time do i legally have to move out?

Have you tried to sell the home as a short sale yet? Banks are typically allowing folks to try and sell it instead of just letting it go to foreclosure.

Of course, you need to speak with a real estate attorney regarding any legal issues. We cannot answer those for you unfortunately.

Sara, this is a legal question that you need to talk to an attorney about about. The old answer was 14 days, but there was new legislation on both the state and federal level that might have changed that.

Also, if you have a first and a second mortgage, you probably should talk to a bankruptcy attorney immediately. There are sometimes ways of wiping out the second mortgage and bringing the first mortgage current. But if you do nothing you may end up without your house and still owing money on the second mortgage.

You need to contact a real estate agent who does short sales in your area right away to see if you can get this postponed. Also, contact an attorney about bankruptcy and check out your options if you are planning to file anyway as this will often buy you more time and protect you if you are unable to make the payments for at least a while. Realtors can't give you legal advice so you need an attorney (waiting to call one until after the auction will likely hurt your chances of being able to stay.)

FIRST ANSWER

you may still have time to postpone or cancel that sale!! But if you choose not to do that, you will be contacted by the banks agent soon after they foreclose..they will more than likely offer you " cash for keys" - money to move out, clean the house for them and give them the keys- and you can get an average of 30 days to move out- sometimes more.
