loan modification I have been working on my modification since december Hope and Hud are helping me

I have been faxing my paperwork from the Hud office and calling Litton loan every week, I have also been sending the payments they required the originall y told me it would take 60-90 days, it is now 6 months, yesterday I recieved a letter from millsap and singer to say I am in foreclosure and my house is to be sold in July , I do not understand what is going on Litton and I had a conference call at the Hud office 2 weeks ago and I was told my modification had been approved and I should receive the paper work, now I am getting a letter from millsap and singer. What do I do???

Please keep in mind that this answer comes from one who recently lost their home to foreclosure. It has been my experience that as far as the Lender is concerned, the right hand never seems to know what the left hand is doing. I was told that my modification would be approved if i just resubmitted the paperwork - the lender then sold my loan to another servicer who knew nothing about it and ....my house was sold at auction on 03/13/09. HUD doesn't really do anything but give false HOPE ( as does the program by that name. Consult an attorney - not the Lucas Law Center - but one that is actually a real estate attorney. Call the number on the notice of sale and see what you can work out with them. In then end, above all else, remember, the only who really cares about keeping you in your home, is you. I hope that your situation works out better than mine, but in the end, you must remember that everything happens for a reason. Best of luck to you.

Contact Litton and push. Make them aware you are set to go to sale in July and aske where is the mod or trail mod under the stimulus program. There have been many issues with this type of situation that I have noticed since 3/4/09 when the stimulus program was announced. There has been a lot of confussion and a lag in implementation from the annoucnement of the program. In addition with the lenders they treat foreclosure and loss mit (modifications) as mutually exclusive events and thus until the loss mit department tells the foreclosure department to place the case on hold, foreclosure will continue.

FIRST ANSWER

Call Litton and see what is going on. They may have put the request in to Millsap and Singer before the modification was approved. If they won't approve the modification see if they would consider a short sale where you sell the property for less than you owe. I can help you with this and may even buy the house myself (I invest in houses in addition to being an agent). Often times they will hold off on the foreclosure while you try to sell the property. If your loan was originally with a different lender and Litton purchased it another option that may work is to tell them to "produce the note". Basically many times the bank who bought your loan won't have the original note you signed against the house. Without the note there is no proof that you need to pay them anything and they cannot foreclose until they get it.
