The bank can not do anything with the house payments that are not in the mortgage or note or agreed on between you and the mortgage company. However, if your behind and wish to keep your house they can negotiate with you via a repayment plan, modification or plan to reinstate the loan.

You can renegioate with a bank if you are behind on mortgage payments. Banks do not want you to foreclose and will sometimes listen within reason until you are back up to par.
