bank of america says they are exempt for the ca forclosure moratorium they say they are participating inthe HASP program. However they have no way to implement hasp in place. they can help anyone until they do...if they do, yet they are exempt because they promise to. How can they get away with this and is there anything I can do or report this fraud to?

Welcome to the new world of modification. The hasp plan was authorized 3/4/09, but the understanding of the plan is still under study and not implementation. It took me 3 months to get a trail mod approved by litton mortgage after they rejected a mod prior to the hasp program. The reason for denial was just so litton could move on and recieve the incentives associated with the hasp program. No one gives clear direction or explanations they seem to just move for the process. The real problem was the courts did not listen either!

Go to the hud counselors but stay on top of bank of america because the hasp program indicates if you really want to keep your house that they should be helping you.

Hi Kathy, according to the following, BofA is in fact exempt in CA:

I would suggest you contact a HUD-approved foreclosure avoidance counseling entity from this list:
