In addition to the great advise you are getting from the other answers I would contact the Principal Broker in the office. As a broker I would like to know if any of the agents in my office are violating the law or behaving in an unethical maner, most Brokers will take the necessary to ensure that ethical behavior whithin their office is maintained. Should this step yield no results then, reaching out to the department of state would be the next option.

It doesn't if the Agent belongs NAR or not you can file a complaint with the state..

You have a couple of options:
1. The agent should be licensed by the Dept. of Real Estate.
http://www.dos.state.ny.us/LCNS/licensing.html
2. Not all agents are Realtors, or members of the National Association of Realtors. Realtors are required to adhere to the Code of Ethics (see http://www.realtor.org).

Depending upon how this agent is affiliated, you can file a complaint with the state dept. of licensing, file a grievance if they are a Realtor, of perhaps sue them in court.
Good luck.
