What do I do when you have been approved for a modification and the payment is higher than your current payment and you accept doing the modification?

after 1yr of trying. To top it all off they send you the forms back 4 times and each time mark something different instead of marking all that was needed in the first place then to top that you find a Fedx package on you porch the day after the modification has expired. So I send it back anyway once again to get it back 3 days later to tell me the modification expired. Oh I didn't mention that I tried to call several times and to be told the computers are down and to call back in 2-3 hours. So when I get off work and get home so I can call their closed! Oh I didn't even mention the time I was hung up on and the other time where I stayed on hold so long that the elevator music stopped playing and left me with dead silence. Of course Countrywide now Bank of America. Did I mention I was once an employee and was in the mtg business so I feel bad for those not so knowledgeable customers. Help what can I do or should I do? This is so ridiculous help me!

I have run into the same situation with Litton Mortgage. I was working with a customer who did not pay them timely right before the Obama plan was setup. Littion would not let him go thru with that plan and made him submit an application via makinghomesaffordable. Which he did. They they sat on it until it went to court for the first legal and then when he indicated that he was trying to get a modification, they sent one a couple 100 dollars higher than the original agreement for a trail. However, after the first payment they increased the payment 500 dollars indicating that they made a mistake on the first modification. They I assisted him to try to get someones attention. I got their attention, however, the results were not good. After 5 e-mails, a quailified written request and a number of conversions they indicated that the new payment was right according to their policies,procedures and formulas. This was after I recapped his income to be $10,000 less a year than they indicated. The again indicated my caluclation was correct but the formula they were using was correct and the payment was correct. This was when I was dealing with vice presidents! They let the processors do the work and no one checked the work. Here is the kicker! A week later Litton sent the customer a revised payment plan 200 dollars higher. So there last offer was almost twice what the original plan was. Now I am refering customers to the hud approved counselors to tdeal with them.

I only help after the counselors have started the process now. Before I had better results but now I think the counselors will do better to check to make sure the banks are calculating everything correctly.

Funny... I knew you were talking about BofA even before you said it.. sounds very familiar... You can always try again or perhaps you may want to get help from an attorney.., Just be careful and research the company you go with if you chose that route. I have had a client who received a bad modification from BofA then tried again and got a good modification and sent it in on time w. all requested documents only to have their payments denied 4 months later even after paying 3 payments on time... they claimed that she never sent in the correct documents and so her modification was now revoked...
This kind of mess is not always the case but it happens... another bit of advice make sure you are talking to the loss mitigation department when you call and not customer service...sometimes even if you call the loss mitigation number they transfer you to customer service if there is too many calls... if you talk to customer service they do not update the notes to the right department. You may also try to get the information of the negotiator assigned to your case....this could be tricky but most of the time the negotiators email is their
first name .last name@bankofamerica.com so if you can get their name you may have a direct communication method which helps...

It seems like you are getting the run around. When was the letter sent?

You have proof of the day you received the package. Its may be time to get help.

I work for an attorney and we specialize in Loan Modifications and subjects of that matter.

A couple calls from an attorneys office may be what is needed.
